By accessing or using PostGun ("the Service"), operated by PostGun AI ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PostGun is a social media content management platform that provides tools for creating, scheduling, automating, and publishing content across multiple social media platforms. The Service includes AI-powered content generation, slideshow creation, media management, campaign orchestration, and analytics features.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Workspaces and Organizations

The Service allows you to create and manage workspaces (organizations). As a workspace owner, you are responsible for the actions of all members you invite. You may assign roles with varying levels of access. Workspace owners are liable for ensuring members comply with these terms.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload, post, or distribute content that is unlawful, defamatory, obscene, or infringing
  • Engage in spam, phishing, or any form of unsolicited mass communication
  • Circumvent rate limits, usage quotas, or other technical restrictions
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated means to scrape, crawl, or extract data from the Service beyond the intended API
  • Impersonate any person or entity or misrepresent your affiliation
  • Distribute malware, viruses, or any harmful code through the Service

6. Content Ownership and License

You retain all ownership rights to the content you create, upload, or publish through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to host, store, process, and display Your Content solely for the purpose of providing and improving the Service.

Content generated by our AI tools is owned by you upon creation, subject to the underlying intellectual property rights of any source materials used. You are solely responsible for ensuring that Your Content does not infringe upon the rights of any third party.

7. Third-Party Platform Integrations

The Service integrates with third-party social media platforms (e.g., TikTok, Instagram, YouTube). Your use of these integrations is also subject to the respective terms of service and policies of those platforms. We are not responsible for changes, outages, or policy enforcement by third-party platforms that may affect the Service.

8. Credits and Payment

Certain features of the Service require credits or a paid subscription. Credits are non-refundable and non-transferable unless otherwise specified. We reserve the right to modify pricing, credit allocations, and subscription tiers with reasonable advance notice. Failure to maintain an active subscription or sufficient credits may result in reduced access to features.

9. AI-Generated Content

The Service uses artificial intelligence to generate content suggestions, captions, images, and other materials. AI-generated content is provided "as-is" and may not always be accurate, appropriate, or suitable for your purposes. You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing. We make no warranties regarding the accuracy, originality, or fitness of AI-generated content.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

11. Limitation of Liability

To the maximum extent permitted by law, PostGun AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless PostGun AI, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. You may terminate your account at any time through the account settings. Upon termination, your right to use the Service ceases immediately. We may retain Your Content for a reasonable period to allow you to retrieve it, after which it will be deleted.

14. Modifications to Terms

We reserve the right to update these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Delaware.
